General Terms and Conditions
1. Scope of application
The following terms and conditions apply to all orders placed by consumers via our "humstore online shop".
For the purposes of the following provisions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
2. Contracting parties, conclusion of contract
The purchase agreement is concluded with humstore GbR.
By listing the products in our online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive a confirmation email.
3. Electronic Communication
By placing a binding order via our online shop humstore, you agree to electronic communication regarding the contract. Order processing and contact usually take place via email and automated order processing. You ensure that the email address you provide for order processing is functional so that you can receive the emails we send. In particular, if you use spam filters, you must ensure that all emails sent by us can be delivered.
4. Contract language, contract text storage
The language available for concluding the contract is German. We do not store the contract text.
5. Delivery conditions
In addition to the stated product prices, shipping costs will be added. Further details on the amount of shipping costs can be found on our shop page under the menu item "Payment and Shipping".
We only deliver by mail. Unfortunately, in-person pickup is not possible.
6. Payment
The following payment methods are generally available in our shop:
Prepayment
If you choose prepayment as your payment method, you can find our bank details in the order confirmation, which will be sent to you automatically after you place your order. The goods will be delivered to your desired address after receipt of payment.
Credit card via PayPal
If you have chosen credit card as your payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment instruction and after your identification as the legitimate cardholder by your credit card company at the request of PayPal, and your card will be charged. Further information will be provided during the ordering process.
PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first. After placing your order in the shop, we will instruct PayPal to initiate the payment transaction. The payment transaction will then be automatically processed by PayPal immediately afterwards.
Giropay
After confirming your order, you will be redirected to your bank's website. To pay the invoice amount via Giropay, you must have a bank account activated for online banking, identify yourself accordingly, and confirm the payment instruction to us. Further instructions will be provided during the ordering process. The payment transaction will be carried out immediately afterwards and debited to your account.
Apple Pay
To pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with the service provider Apple, have the Apple Pay function activated, log in with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information will be provided during the ordering process.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Transport damage
For consumers, the following applies: If goods are delivered with obvious transport damage, please contact us immediately. Failure to make a complaint or contact us will not affect your legal rights and their enforcement, especially your warranty rights. However, it will help us to assert our own claims against the carrier or transport insurance.
9. Warranty and Guarantees
Unless explicitly agreed otherwise, the statutory liability for defects applies.
10. Liability
We are always liable without limitation for claims due to damages caused by us, our legal representatives or vicarious agents.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper performance of the contract and on the observance of which the contracting party may regularly rely, due to slight negligence on our part, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
